Refunds And Cancellations

WITHDRAWAL OF APPLICATION & TERMS OF REFUND

Withdrawal of Application Refunds -
Members are allowed a period of 10 calendar days from the date of VHL's realization of the Down Payment to withdraw their membership applica- tion and claim @ REFUND subject to a withdrawal change of INR 15000 + 2.5% Bank Charges + GST of 18% towards administration & processing charges. If the application of withdrawal duly signed by the Member (in case of Joint application both the Principal Member and Co-applicant) is not received by VHL within the 10 calendar days from the date of receipt of the Down Payment, the Members right to claim the withdrawal and the Members entitlement to REFUND shall lapse. For the purpose of making this important communication on time, VHL recommends that you use Speed Post / Registered Post/Courier Services for communicating with VHL.

Cancellation by Member Fully Non Refundable -
Cancellation of Membership is not allowed and not acceptable under any circumstnaces or situation after the completion of Free Look period which is of 10 days after the realization of the Initail payment made at the time of Memibership application. Memiber can only withdraw the application within the free look period only. Hence the Membership is completely Non-Refundable.

HL reserves the right fo terminate the VHL Membership on occurrence of any of the following events -
1. Default in payment of Membership Price by the Member
2. Default in payment of AMC in ful or in part for two consecutive years by the Member.
3. Breach of House Rules of VHLHR/VHLAHR located outside India by the Member Breach of Contract by the Member.
4. Any other action by the Member and/or his/her/its guests or occurrence of any event or situation within the premises of VHLHR or VHLAHR or
5. Gt resorts located outside India which constitutes a criminal offence against the Member or those accompanying the member.

DEFAULT IN PAYMENT OF INSTALLMENTS/ANNUAL MAINTENANCE FEES

In cases of default in payment of any instalment/s VHL shall have the right to terminate the VHL Membership in accordance with the Rules if the same is not paid.

Without prejudice to the right of cancellation, VHL reserves the right to collect the delayed payment annually from the Member together with 24% interest.

Appropriation of Payments -
In case of part payment made by the Members towards any outstanding shall first be appropriated towards interest and then earlier dues/ outstanding.

Gifting

A Member can gift his/her its Membership entitled days. This privilege is subject to payment of quest fees/charges/ tiered charges and such terms and conditions as may be specified by VHL from time to time. The Member's immediate family members le. spouse, parents children (upto 25-years of age] are excluded from the payment of guest fees charges. Maximum of 1 guest bookings are ollowed in a financial year subject c maximum number of 2 days. Further no guest booking will be entertained during peak season and black out period as intimated by VHL from time to time.

TRANSFER OF MEMBERSHIP, ETC.

A Member (including both members in case of joint membership)who has paid the full Membership Price is entitled to transfer his/her its Mem bership only after the completion of a period of 2 (two) years from admission as Member (without spiting the Membership) to any person provided there are no dues payable by the Member to VHL. Any such transferee shall be registered as Member only when he/she surrenders the Original VHL Membership Certificate, Membership Card and an Authorization Letter of the previous member for the Transfer In adition to the above, the transferor shall also produce the document of transfer as prescribed by VHL duly executed by the previous Member ond such other documents prescribed by VHL and pay such fees as prescribed by VHL from time to time towards transfer charges for proce the Transfer of Membership. Any such transferee shall be entitled to avail the Membership benefits or entitlements only during the unexpired Portion of the Membership Usage Period subject to the terms and conditions contained herein. Re-issuance of the Membership Cerri be processed within 30 days from the date of submission of transfer application along with necessary documents.

A Member (either of the Member in case of joint membership) entitled to bequeath his/her right ina Membership (without spliting the Mem- bership) to any person subject to applicable charges of INR 15,000 + GST towards Administration and processing services. However, such legatee shall be registered as Member only when he/she surrenders the original VHL Membership Certificate and Membership Card proof of such bequest and subject to such conditions and production of such documents os may be prescribed by VHL in this regard from time to time. Any such legatee shall be entitled to enjoy the holiday membership and entitlements only during the unexpired period of the Membership subject to the terms and conditions contained herein and only after a fresh VHL Membership Certificate is issued.

In the event of death of an Applicant/ Member the Application/Membership shall be automatically transferred to the surviving Co-Applicant in the case of joint applications/Memberships) subject to all liabilities and obligations of the deceased and on production of death certificate of the deceased Member and such other documents as requested by VHL, a fresh VHL Certificate shall be issued to the survivor on surrendering the original VHL Certificate and if applicable, the Membership Card also,

4 nthe event of any Applicant/Member dying intestate the Membership shall be transferred to the legal heirs on production of Death Certificate cand Legal Heirship Certificate (and such other documents os may be required by VHL. A maximum of 2 heirs shall be allowed to inherit the membership in cose of single applicant membership.

In all cases, the legel heirs/successors to the deceased Applicant/Member shall be entitled for only the unexpired portion of the Membership for obtaining a fresh VHL Certificate from VHL & shall be subject to all liabilities & obligations of the deceased Applicant/Member.

VHL shall have the sole right to refuse the transfer of Membership to any person who has been refused VHL Membership by VHL or having been Cedmitted to VHL Membership and the Membership wos terminated/cancelled for any reason.

Membership once transferred, the new member cannot transfer within a period of 2 years from the date of such transfer. The terms of the new member will be governed by the membership rules and regulation as applicable on the date of transfer.

The authorized person in whose favour confirmation voucher issued shall produce the proof of identity on request from VHL.

VHL shall have the sole right to refuse the gifting to any person who has been refused VHL Membership by VHL or having been admitted to VHL ‘Membership, the Membership was terminated for any reason in the opinion of VHL is financially insecure or otherwise commercially undesirable to the interests of VHL. VHU's decision in this respect shall be final and binding.
